Acceptance of Terms

Welcome to alleighsomersphotography.com (the "Site"), operated by Alleigh Somers Photography ("we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site.

These Terms govern your use of the Site only. Photography services, sessions, and deliverables are governed by a separate Photography Service Agreement signed at the time of booking. In the event of a conflict between these Terms and your Photography Service Agreement, the Photography Service Agreement controls.

Use of the Site

You may use the Site for personal, non-commercial purposes. You agree not to:

  • Use the Site in any way that violates applicable law or regulation

  • Scrape, harvest, or extract content from the Site through automated means

  • Attempt to gain unauthorized access to any portion of the Site

  • Interfere with the Site's operation or security

  • Use the Site to transmit malware, spam, or other harmful content

  • Impersonate any person or entity

  • Reproduce, distribute, or commercially use any content from the Site without our prior written consent

Intellectual Property

All photographs, images, video, written content, logos, brand marks, design elements, and other materials displayed on the Site are owned by Alleigh Somers Photography or used with permission. All such content is protected by United States and international copyright, trademark, and other intellectual property laws.

Specifically regarding photographs:

  • All photographs displayed on the Site are the copyrighted property of Alleigh Somers Photography unless otherwise noted.

  • Photographs may not be downloaded, copied, reproduced, distributed, transmitted, displayed, sold, licensed, or used for any commercial purpose without prior written consent.

  • Screenshots, screen recordings, or other unauthorized reproductions of photographs are prohibited.

  • Right-click-saving, scraping, or printing of photographs without consent is a violation of these Terms and applicable copyright law.

  • Pinning to Pinterest or sharing via social media platforms with proper attribution to Alleigh Somers Photography is permitted for personal, non-commercial use only.

Clients who have received delivered photographs from a session or wedding are granted limited usage rights as outlined in their individual Photography Service Agreement.

Client Galleries

Private client galleries hosted through Pixieset are governed by:

  • Your individual Photography Service Agreement

  • Pixieset's Terms of Service and Privacy Policy

  • These Terms

Gallery access is granted to clients and is not transferable. Sharing gallery access credentials with unauthorized parties is prohibited.

Inquiry and Contact Forms

When you submit an inquiry or contact form, you agree to provide accurate information. We will use the information you provide as described in our Privacy Policy. Submission of an inquiry does not create a contractual relationship — a Photography Service Agreement is required to formally book services.

Disclaimers

THE SITE AND ALL CONTENT, MATERIALS, AND INFORMATION ON THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ALLEIGH SOMERS PHOTOGRAPHY, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Alleigh Somers Photography from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to your violation of these Terms, your use of the Site, or your violation of any rights of a third party.

Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party site. Links are provided for convenience only and do not constitute endorsement.

Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be resolved in the state or federal courts located in Marion County, Indiana, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The "Last Updated" date will be revised when changes are made.
